1. Acceptance of Terms

By downloading, installing, or using the SalonReady AI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Description of Service

SalonReady AI is an AI-powered mobile application that:

• Analyzes your facial features from uploaded photos
• Provides personalized hairstyle recommendations based on your face shape, features, and preferences
• Generates AI-powered preview images showing how recommended hairstyles may look on you
• Allows you to save, share, and manage your hairstyle looks
• Provides salon-ready reference cards for your stylist

3. Eligibility

You must be at least 13 years old to use the App (or 16 years old if you reside in a jurisdiction that requires a higher minimum age, such as certain EU member states or South Korea). If you are between the minimum age and 18 years of age, you must have parental or legal guardian consent. By using the App, you represent and warrant that you meet these eligibility requirements. The App includes an age verification step during onboarding.

4. User Accounts

The App creates an anonymous account based on your device identifier. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

5. User Content

5.1 Photos You Upload

By uploading photos to the App, you:

• Confirm that you have the right to use and share those photos
• Grant us a limited, non-exclusive license to process and analyze those photos for the purpose of providing the service
• Understand that photos will be processed by our AI systems and third-party AI providers

5.2 Generated Content

AI-generated hairstyle preview images are created for your personal, non-commercial use. You may save and share generated images, but you may not use them for commercial purposes without our written consent.

6. Subscriptions and Purchases

6.1 In-App Purchases

The App offers the following purchase options:

• Weekly Pro subscription: A weekly auto-renewing subscription that provides 5 looks per week and access to premium features
• First Look: A one-time consumable purchase for your first hairstyle preview experience
• 3 Look Pack: A one-time consumable purchase of 3 hairstyle looks, no subscription required

Additional products may be introduced in future updates.

6.2 Payment and Billing

• All purchases are processed through the Apple App Store
• Subscription payments are charged to your Apple ID account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions

6.3 Refunds

Refunds are handled by Apple in accordance with the App Store's refund policy. To request a refund, visit reportaproblem.apple.com.

6.4 Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled. You can cancel at any time during the trial without charge.

7. Acceptable Use

You agree not to:

• Upload photos of other people without their consent
• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any security features or usage limits
• Use automated systems or bots to access the App
• Upload content that is offensive, harmful, or violates any third-party rights
• Resell, redistribute, or commercially exploit any part of the service

8. AI-Generated Content Disclaimer

Important: SalonReady AI uses artificial intelligence to generate hairstyle recommendations and preview images. Please be aware that:

• AI-generated results are approximations and may not perfectly represent how a hairstyle will look in real life
• Recommendations are suggestions only and should not be considered professional styling advice
• Actual results at a salon may differ from AI previews due to hair texture, color, condition, and stylist interpretation
• We do not guarantee the accuracy, completeness, or suitability of any recommendation

9. Intellectual Property

The App, including its design, features, code, content, and trademarks, is owned by SalonReady AI and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied
• We do not warrant that the App will be uninterrupted, error-free, or secure
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless SalonReady AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) will survive.

13. Third-Party Services

The App integrates with third-party services (including AI providers and payment processors). We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at support@hairmatchai.com and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved this way.

14.2 Binding Arbitration

If we cannot resolve a dispute informally, you and SalonReady AI agree to resolve any claims relating to these Terms or the App through final and binding arbitration, except as set forth below. The arbitration shall be administered under the rules of a mutually agreed-upon arbitration body. The arbitration will be conducted in English.

14.3 Class Action Waiver

You and SalonReady AI agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of the arbitration provision shall be null and void.

14.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14.5 European Union Residents

If you are a consumer residing in the European Union, nothing in this section shall deprive you of the protection afforded by the mandatory provisions of the consumer protection laws of your country of residence. You may bring proceedings in the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

For users residing in the European Union or the United Kingdom, this choice of law does not deprive you of the protection of the mandatory consumer protection provisions of your country of residence.

16. Right of Withdrawal (EU/UK)

If you are a consumer in the European Union or the United Kingdom, you have a 14-day right of withdrawal for digital purchases. However, by making a purchase and beginning to use the digital content (such as generating a hairstyle preview), you acknowledge and agree that you lose your right of withdrawal once the digital content has been fully provided.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SalonReady AI regarding your use of the App, superseding any prior agreements.
